Tier 2 (Intra-Company Transfer) migrants are skilled workers moving from an overseas branch of a company to a UK branch.
Under This mode of immigration, Sponsors can issue Sponsorship certificates to the workers moving in to UK without compliance to the resident Labour market test. Currently, the number of applications issued entry clearance under Tier 2 is unlimited.
Under the four subcategories of Tier 2 (Intra-company Transfer), Applicants applying for short-term and long-term transfer are required to be working for the sponsor company for no less than a year before they put forward their application. Such applicants are granted entry if the capacity could not be fulfilled inland from the sponsor company’s UK workforce. Short-term workers are granted entry up to one year, and long-term workers up to five years.
Under the Graduate Trainee category, the applicant only need to show their proof of employment with the Sponsor company and the tenure of employment should be three months or more.
Long-term workers must be remunerated corresponding UK-equivalent annual salary of at least £40,000.
The initial tenure of Tier 2 migrants in UK is for three years and one month and can be extended to maximum of five years. After which the migrant must leave UK and shall not return as Tier 2 migrant for 12 months.
Similarly, Short-term workers are admitted to UK for maximum one year with salary of at least £24,000. After the completion of their tenure in UK, they must leave UK with additional 12 months bar to be re-transferred under Tier 2 to UK.
Graduate Trainee applicants serve the similar tenure of 12 months and must be paid £24,000 at least and face similar barring of 12 months to be re-transferred under Tier 2.
Short-term, Graduate Trainee migrants required not to spend 12 months outside UK before they return under Long-term worker category.
Tier 2 (Intra-Company Transfer) migrants already in UK under the Rules in place before 6 April 2011 will be able to apply to extend their stay without being subject to the new graduate-level job requirements or the new salary thresholds. Workers in the established staff subcategory in place before 6 April 2011 can apply to extend their stay beyond five years.
Language proficiency level is B1 (Common European Framework) for Tier 2 (General) migrants. As for Intra-Company Transfer migrants, there is no language requirement for tenure exceeding three years.
Tier 2 (Intra-Company Transfer) migrants must show maintenance requirement funds of £900 to support themselves for the first month after entry to UK. However, this amount is exempted if Sponsor Company certify the worker’s first month stay.
Turkey, being a member of EU, is provisioned special rights to its citizens, under which Turkish nationals can work as self-employed in UK. Previously, such rights were provisioned to Bulgaria, Romania, Poland and states recently joining EU. Under such agreement, All citizens of EU can work in UK as self-employed.
The Ankara Agreement, an Association between the Republic of Turkey and European Economic Community, gives additional privileges to Turkish nationals and Visa policies are more lenient under this and all prevailing agreements. However, this agreement is not provisioned to Turkish nationals entering UK illegally.
